The CBAr Study Group on the CISG and Arbitration established, in a joint effort with the CISG-Brazil website, the CISG Case Law Research Group.
In 2015, the CISG Case Law Research Group compiled Brazilian case law on the convention. The research conducted by the group did not have an initial time limit (i.e., the time limit imposed by each court’s search system was used) and sought decisions from all Courts of Justice, the Superior Court of Justice and the Federal Supreme Court that mentioned the CISG, up to October 6, 2015.
A total of 81 decisions were found, none of which directly applied the CISG as a rule governing the merits of the dispute. However, these judgments expressly refer to the CISG as a source of inspiration (soft law) for Brazilian law, including in purely domestic cases.
The 81 judgments found were tabulated in a spreadsheet.
